3. PAYMENT: Licensee shall pay the amounts specified in paragraph 2 when due, without abatement, set-off, or deduction of any amount whatsoever. Licensor may at its election collect all fees, costs, charges and other amounts due to Licensor under this Agreement, or any part thereof, out of the Receipts (as said term is defined in paragraph 12 hereof) if any, and said Receipts are hereby assigned by Licensee to Licensor to the extent of the sum of all amounts to be paid by Licensee under this Agreement which may at any time be due and unpaid to Licensor.


Licensor shall not be obliged to permit Licensee the use of the premises until each payment required under this agreement to be paid prior to such use has been made, and
Licensee agrees that if said payments are not made Licensor may, without further notice of any kind to Licensee or to any other person, refuse to open the doors of the premises until all such payments have been made.


On any default in payment of Licensee, Licensor shall retain all monies paid and Licensee shall remain liable for the balance. Licensee shall remain liable for the balance.

Licensee shall pay to Licensor such amounts as Licensor incurs with respect to any default by Licensee, and all costs and expenses incurred by Licensor in the preservation of its rights, and collection of amounts due to it, under this agreement, including but not limited to, reasonable attorneys fees.

24. PROTECTION FROM INJURY: If in Licensor’s sole judgment injury to any person in or about said premises or the Building, and/or damage to said premises or the Building, may arise out of or result from any engagement under this Agreement, then Licensor shall have the right in its sole and absolute discretion to take such steps and to perform such acts as it deems necessary or appropriate to protect such persons from injury, and/or said premises of the Building from damage, including but not limited to engaging additional security guards and/or other personnel, and Licensee agrees to pay Licensor, upon demand, in addition to any other sums provided in this Agreement, Licensor’s charges for taking such steps.

3. PLATA: Locatarul va plăti sumele specificate în paragraful 2 la momentul scadenţei, fără reduceri, compensaţii sau deduceri, în orice sumă ar fi acestea. Locatorul poate să perceapă toate comisioanele, costurile, taxele şi alte sume datorate în conformitate cu acest Contract, sau orice parte din acestea, din Încasări (aşa cum este definit termenul în paragraful 12 din prezentul document), dacă acestea există, iar Încasările menţionate sunt transmise prin prezenta de către Locatar către Locator în limita sumei globale constituite din toate sumele ce trebuie plătite de Locatar în conformitate cu acest Contract, care pot fi datorate în orice moment şi sunt neplătite, în favoarea Locatorului.

Locatorul nu va fi obligat să îi permită Locatarului să utilizeze spaţiile până ce fiecare plată impusă prin prezentul contract nu va fi fost plătită înainte de utilizarea acestora, iar Locatarul este de acord că, dacă respectivele plăţi nu sunt efectuate, va putea, fără notificare prealabilă, de orice tip ar fi aceasta, către Locator sau alte persoane, să
refuze deschiderea uşilor de acces în spaţii până ce nu s-au efectuat aceste plăţi în totalitatea lor.

În caz de neplată din partea Locatarului a celei de-a doua tranşe, Locatorul va reţine toate sumele de bani plătite, iar Locatarul va rămâne răspunzător pentru restul soldului.

Locatarul îi va plăti Locatorului sumele pe care le-a cheltuit datorită
neonorării obligaţiilor de plată de către Locatar, cât şi toate costurile şi cheltuielile suportate de Locator pentru protejarea drepturilor sale şi perceperea sumelor datorate lui, în conformitate cu acest contract, ceea ce include, fără a se limita la, comisioane de avocat rezonabile.

24. PROTECŢIA CONTRA VĂTĂMĂRILOR CORPORALE: Dacă, în opinia exclusivă a Locatorului, se pot produce vătămări oricărei persoane în interiorul sau în preajma spaţiilor sau a clădirii, precum şi/sau stricăciuni în spaţiile menţionate sau asupra Clădirii, ca rezultat al unui angajament asumat în conformitate cu prezentul Contract, atunci Locatorul va avea dreptul să întreprindă paşii necesari şi să efectueze acţiunile pe care le va considera necesare sau adecvate pentru a proteja aceste persoane de vătămare, şi/sau spaţiile menţionate ale Clădirii de avariere, ceea ce include, dar nu se limitează la angajarea de paznici suplimentari şi/sau a altui personal, iar Locatarul este de acord să îi plătească Locatorului, la cerere, pe lângă orice alte sume prevăzute în acest Contract, taxele Locatorului pentru întreprinderea acestor măsuri.
