i don't think it's "الأساس لوجود" In other places it is قاضي الأساس without the word "وجود" for example:
القول بوجود الاحتذاء بقصد الغش هو من الأمور المادية المتروك تقديرها لقاضي الأساس الّذي يتوجب عليه أن يأخذ بعين الاعتبار مقدرة الجمهور على التمييز بين التسميات المشابهة......

Though I have never heard of it, but the term قاضي الأساس seems to exist. http://www.arabiclawyer.org/tempd.htm
I just have no idea what the English term for it is.

I don't think it is "قضاة الأساس" but "الأساس لوجود", it makes more sense. But would it fit in the context of the beginning of the sentence?

agree Fuad Yahya : This is correct, but it is not equivalent to "justice of the peace." In the U.S., we use the expression "trial judge," defined as "judge at a trial court." A trial court is a court of first instance.

Many thanks. I was referring to the English legal courts system where the Justice of the Peace is ofter the first instance judge. I'm not familiar with the court system in the USA
