This was taken from the deposition of a witness (1764), regarding the attempt of the Protestants of Rosenberg to lay claim to part of a tithe in Neidelsbach:
“Ferner seye ihnen in gemeldtem Regierungs-Rescript 100 Thaler Straf mit gedroheter Execution angesetzt worden, in so fern sie sich noch einmal unterstehen würden, dem Neidelspacher Zehenden nachzugehen, worwieder sie aber protestirt, und ihr Klagen vorbehalten hätten.”
Proposed translation:
In addition, a 100-thaler fine, with the threat of execution, was placed on them in the said governmental rescript, if they should once again dare to go after the Neidelsbach tithe, against which they protested, and...ihr Klagen vorbehalten hätten.

I don't think the Protestants of Rosenberg are planning to sue anyone.
PS You may wish to translate 'Execution' differently, as I don't think this is a hanging offence.

Actually, I appreciated your suggestion, as it makes sense in context. However, I couldn't see that interpretation coming from the words written in the original document. "Klagen" doesn't really mean "claim," and "vorbehalten" doesn't really mean "to vow" or "to reassert"...so I guess I went with a more literal suggestion. I didn't know one simple choice on my part was going to turn into a mess like this. I have no horse in this race. I was just asking for other people's take on this phrase... |
