Spanish to English Law/Patents Law (general) Power of attorney
Hello all,

Hope you can help me, I am translating a power of attorney, on the general information where it states the place and date of birth, etc, of the grantor, it also specifies he is a "representante común mercantil, socio o accionista de personas morales", it keeps on stating his address and the info of his ID so that is the only context I have.

Wondering if it is as simple as "commercial common representative" but it doesn't sound right to me

Oh yes, sorry, there is no more context about what could it be referring to, it gives just more personal information and continues with the normal template of any power of attorney.

More context please 1) What country is this from? 2) "común" could mean "joint" - i.e. he is acting as a joint representative or agent; is there anything in the text to indicate whether this is the case?

Commercial legal representative

It would help to know the country of origin of the power of attorney, as it is very likely the meaning of the original will vary depending on the country of origin.

The proposed translation is accurate if the power of attorney was issued in Spain, where a "representante mercantil" is a person with a power of attorney limited to commercial legal matters. The word "común" can be disregarded for translation, as its meaning under Spanish law would not impact the translation.

General versus specific for a one-off deal or dealing.

I agree with Maria E.G. that we need to know the hallowed country of origin.

My first mercantile thought - from the UK Sales of Goods Acts of yesteryear - was a 'factor' - nowt to do with factoring of invoices or accounts receivable, but I can''t work that title unambiguously into the translation cf. 'general factor' as a person or statistic.
Example sentence:

General Mercantile Agents, i.e. an agent who has full authority to perform all functions relating to the business on behalf of his principal.

In the United Kingdom, most factors fall within the definition of a mercantile agent under the Factors Act 1889 and therefore have the powers of such.
