English term (edited): (judicial review with) careful and anxious scrutiny

Az "anxious scrutiny" jogi terminus, bár a magyar jogban ismeretlen fogalom, így nem csoda, ha nem találunk rá az angol-magyar szótárakban.
Az én javaslatom a "(judicial review with) careful and anxious scrutiny" magyar fordítására:
"alapos és tételes ellenőrzéssel végrehajtott (bírósági felülvizsgálat)"

A "scrutiny" maga nem jelent vizsgálatot, hanem inkább tételes ellenőrzést, amely korábbi jogesetek kivizsgálásán keresztül történik. Az "anxious scrutiny test" kereséssel sok példát találhatsz.

Anxious scrutiny: Invoking a doctrine that emerged prior to and independently of the HRA, the common law applies varied, and especially rigorous, standards of review in cases engaging fundamental rights. Under the principle of "anxious scrutiny" a defendant public body is required to demonstrate proper justification and high standards of fairness. Anxious scrutiny is an external prohibition, not an internal inhibition like the principle of legality.

"The Court must, I think, be entitled to subject an administrative decision to the more rigorous examination, to ensure that it is in no way flawed, according to the gravity of the issue which the decision determines. The most fundamental of all human rights is the individual's right to life and when an administrative decision under challenge is said to be one which may put the applicant's life at risk, the basis of the decision must surely call for the most anxious scrutiny."
Lord Templeman spoke to like effect at 537H of the "special responsibility [which] lies on the court in the examination of the decision-making process".
... Anxious scrutiny is not judicial rhetoric, but an established doctrine with a discernable shape and direction. Developing at the hands of a progressive judiciary, it brings English law towards a 'hard look' approach to cases involving fundamental rights, of whose enhanced judicial recognition (...) it is a clear signal.
