Buried in the new (old and defunct!) Lisbon Treaty is the following provision in anticipation of GB joining the Euro:

In order to meet the conditions for joining the Single European
currency, all citizens of the United Kingdom of Great Britain and
Northern Ireland must be made aware that the phrase 'Spending a Penny'
is not to be used after 31st December 2009.

I googled for the directive number, and got 39 hits from various joke sites. The earliest seems to be from 2006.

The format of the number is not right for the real EU anyway - the real numbers of directives generally have the format YYYY/##/EC or YY/##/EC (the order of the elements and the number of digits may vary, but this is basically the pattern).

Given The Sun's penchant for 'world exclusives', I'd say it was the 31st of March. Or earlier.
