Source text - Polish Instytucja odszkodowania została uregulowana w art. 444 Kodeksu Cywilnego, który stanowi, że naprawienie szkody obejmuje wszelkie wynikłe z tego powodu koszty. Poszkodowany ma prawo żądać pokrycia wydatków na leczenie, a co więcej na jego żądanie zobowiązany do naprawienia szkody powinien wyłożyć z góry sumę potrzebną na te cele. Zatem w razie wypadku poszkodowany świadomy, tego że jego leczenie będzie wiązało się z różnymi dodatkowymi kosztami, może zwrócić się do sprawcy o wypłatę tych środków z góry. Konieczne jest aby poszkodowany uprawdopodobnił wystąpienie wszystkich opłat, które będzie musiał w trakcie rekonwalescencji ponieść, może tego dokonać przedkładając rachunki czy odpowiednie zaświadczenia. Koszty te obejmują:
koszty zakupów leków
koszty związane z dodatkowym odżywianiem w okresie leczenia i rehabilitacji
koszty pobytu w szpitalu i zabiegów rehabilitacyjnych
koszty konsultacji u wybitnych specjalistów
koszty środków opatrunkowych i przyrządów rehabilitacyjnych
koszty związane z dodatkową opieką podczas leczenia
koszty poniesione na zakup sprzętu ortopedycznego i protez
koszty związane z przejazdami osób bliskich w celu odwiedzin w szpitalu
Ponadto jeśli poszkodowany stał się inwalidą, zobowiązany musi ponieść koszty przygotowania go do innego zawodu.
Oprócz odszkodowania opisanego powyżej istnieje także inna postać odszkodowania uregulowana w art. 415 Kodeksu Cywilnego: "Kto z winy swojej wyrządził drugiemu szkodę, zobowiązany jest do jej naprawienia."
Translation - English The institution of compensation is regulated in article 444 of the Civil Code, which states that the remedy of damage includes all costs resulting from such. The victim has the right to require the payment of medical expenses and, more importantly, upon request, the obligated party should pay in advance the sum needed to repair the damage. Therefore, in the case of an accident, the victim who is aware that his treatment will be associated with various additional costs may request the offender for payment of these funds in advance. It is necessary that the victim would present all possible occurring fees which would need to be paid during recovery. He may do so by submitting bills or appropriate relevant certificates. These costs include:
cost of medicines purchased
costs related to additional meals during treatment and rehabilitation
costs of the hospital stay and rehabilitation treatment
costs of consultation with outstanding specialists
costs of dressing materials and rehabilitation instruments
costs related to additional care during treatment
costs incurred in the purchase orthopedic equipment and prosthesis
costs related to the travel of relatives visiting the hospital
In addition, if the victim becomes disabled, the cost of preparing for another profession must be borne by the obligated party.
