Source text - Portuguese Comunicamos que a Diretoria do Banco Central, com base no inciso II da Resolução no.
1.203, de 30.10.86, decidiu que podem ser objeto de operações de arbitragem os pagamentos e
recebimentos em moedas estrangeiras, programados ou previstos para ocorrer em momento
futuro, relacionados com:
a) empréstimos e financiamentos registrados no Banco Central;
b) importações;
c) exportações de bens ou de serviços.
2. Por operações de arbitragem entendem-se a compra de uma moeda estrangeira, em
contrapartida com a venda de seu equivalente em outra moeda estrangeira, para liquidação
simultãnea, pronta ou futura.
3. Somente poderão celebrar operações da espécie com os bancos autorizados os respectivos
clientes responsáveis, na forma da legislação em vigor, por pagamentos em moedas estrangeiras
ao exterior, ou por valores em moedas estrangeiras a receber do exterior.
4. Nas compras e vendas de câmbio por arbitragem, para os fins aqui previstos, uma das
moedas negociadas será necessariamente a do efetivo pagamento devido ou à do efetivo valor a
receber.
5 Serão liquidadas por diferença, com base nas disposições do artigo 75, § 1o, da Lei no
4.728, de 14.07.65,
Translation - English Pursuant to item II of Resolution no.1,203 of October 30, 1986, the Central Bank's directorate has decided that payments and receipts in foreign currency scheduled or foreseen in the future may be subject to arbitrage procedures related to:
a) loans and financings registered at the Central Bank;
b) imports;
c) exports of goods or services.
2. The arbitrage procedures referred to in this case are the purchase of foreign currency conversely with the sale of its equivalent in another foreign currency for simultaneous, prompt, or future settlement.
3. Only authorized banks will be permitted to execute such operations with their respective clients responsible, under current legislation, for payments abroad in foreign currency, or for receiving amounts from abroad in foreign currency.
4. Regarding arbitrage exchange purchases and sales, for the purposes hereof, one of the currencies traded will have to be the same currency in which payment is owed, or an amount is received.
5. They will be settled by difference, based on the provisions of Article 75, § 1st of Law no.
4,728 of July 14, 1965,
