This is to advise you that ABC Insurance Company has retained this office to represent you in defense of the above referenced matter. The court records reflect that you have been served with the lawsuit; therefore I am filing an Answer on your behalf. If you have not been served, please notify my office immediately. All personnel in this office are salaried employees of ABC Insurance Company. Nevertheless, my obligation, and the obligation of all employees in this office, is to represent and defend you in this matter. A Statement of Insured Client’s Rights is enclosed and is self-explanatory.
If we have not yet spoken, please call my office upon receipt of this letter to schedule a time to meet with me and discuss the facts of the accident and other matters related to this lawsuit. If you have any questions or concerns regarding my relationship with same, please ask at that time so that we may discuss them. In addition, if this office has ever been involved in another lawsuit in which you were a party, please bring this to my attention since it may assist in avoiding a potential conflict with our representation of you in this matter.
You are being sued for monetary damages. If the monetary damages exceed the liability limits of your insurance policy, you may be personally liable for the excess amount. Therefore, if you have other insurance that may cover you for this accident, please advise me of that fact immediately. In addition, you may wish to hire an attorney at your own expense to protect your interests for amounts over your insurance coverage. If you choose to do so, please let me know your attorney’s name, and I will cooperate fully with that person.
I am only handling the defense of the lawsuit that has been brought against you. If you have a claim for damages against other parties involved in this lawsuit, I cannot represent you for such claims, but will cooperate fully with your personal attorney. If you intend to pursue a claim (or make a counterclaim or cross-claim), please contact your attorney immediately since strict time limitations may apply to such actions for damages. If you decide to pursue a claim, the attorney that you choose to represent you will be at your own expense.
While this lawsuit is pending, please do not discuss it with anyone other than someone from this office, a representative from ABC Insurance Company or your own personal attorney. Also, please be aware that anything you post or place on any social networking site (i.e. FaceBook, MySpace, Twitter, et al.) can be discovered by the Plaintiffs in this lawsuit. Therefore, please avoid posting anything at all related to the accident, the Plaintiffs, or this lawsuit while it is pending.
During the course of this lawsuit, there will be times when you will be called upon to assist me. Consequently, if you move or change your telephone number, please let me know immediately. Additionally, please advise the manner in which you would like to be contacted (i.e., cell phone, email, letter, etc.).
